Even when maintenance is awarded, Texas caps the amount and duration based on the length of the marriage. The limits are specific, and courts do not always award the maximum. Whether maintenance is appropriate in a given case depends on the financial circumstances of both spouses and how the other issues in the divorce are resolved.
